Media Licensing & Copyright Policy

This Media Licensing and Copyright Policy applies to all photographs, video footage, aerial/drone imagery, 3D virtual tours, floor plans, and digital assets ("Media") created by Jordan Odom Marketing LLC ("Company," "we," "us," or "our") and delivered via JordansRealEstateMedia.com.

1. Ownership of Copyright

In accordance with United States Copyright Law (Title 17, U.S. Code), Jordan Odom Marketing LLC retains full and exclusive copyright and intellectual property ownership of all Media created.

Purchasing our media services does not constitute a sale of the copyright or transfer of ownership. Media is provided to the Client under a limited license agreement as described below. None of our work is performed as a "work made for hire."

2. Client Usage License (Real Estate Listings)

Upon payment in full, Jordan Odom Marketing LLC grants the commissioning Client (typically the listing agent or property owner) a limited, non-exclusive, non-transferable, revocable license to use the Media for the sole purpose of marketing and advertising the specified real estate property for sale or lease.

Permitted uses under this license include:

  • Uploading to the local Multiple Listing Service (MLS).
  • Displaying on real estate marketing websites, listing portals (e.g., Zillow, Realtor.com), and personal agent/brokerage websites.
  • Posting on official social media channels to promote the active listing.
  • Printing flyers, brochures, yard signs, and local print advertisements for the specific property.

License Termination: The license remains active until the property is sold, leased, or the listing agreement terminates, after which active marketing of the property must cease.

3. Strictly Prohibited Uses (Third-Party Transfers)

The license granted is personal to the purchasing Client and cannot be transferred, shared, sublicensed, or resold to any third party.

  • No Transfer to Secondary Agents: If a listing expires, terminates, or transfers to a new listing agent, the new agent may not use the Media without purchasing a separate license from Jordan Odom Marketing LLC.
  • No Use by Third-Party Vendors: Builders, interior designers, home stagers, architects, contractors, trade vendors, or commercial entities are strictly prohibited from using our Media for their own commercial portfolios, marketing, or advertising without purchasing a commercial license directly from us.

4. Secondary & Commercial Licensing

If a builder, stager, vendor, or secondary agent wishes to use Media created by Jordan Odom Marketing LLC, they must contact us directly to purchase a Third-Party Commercial License. Discounted co-licensing rates are available when arranged prior to or at the time of the shoot.

5. Rights Reserved by Jordan Odom Marketing LLC

Jordan Odom Marketing LLC explicitly reserves the right to use all Media created for:

  • Marketing, self-promotion, website portfolios, and social media showcase.
  • Entry into photography and videography competitions.
  • Licensing to third parties, editorial publications, or stock media usage, subject to client privacy considerations.

6. DMCA & Copyright Infringement

Unauthorized use, copying, distribution, or re-licensing of our Media constitutes intentional copyright infringement under federal law. Unauthorized commercial usage will be billed at standard commercial licensing rates plus applicable statutory infringement remedies.
